PERTH MOPS & CLEANS TERMS PACK
PART A — RESIDENTIAL TERMS & CONDITIONS
(For household / consumer clients)
1. Consumer Guarantees
1.2 Services are supplied with due care
2. Scope of Services
2.1 Services are limited to those agreed in writing (quote, booking confirmation or invoice).
2.2 Additional services requested on-site may incur additional charges.
2.3 PM&C is not required to perform services not expressly agreed.
3. Quotes
3.1 Quotes are valid for 14 days unless otherwise stated.
3.2 Quotes are estimates only and may vary if:
- Property condition differs from description
- Additional time is required
- Access is delayed
- Undisclosed conditions are discovered
4. Payment
4.1 Payment is due prior to service unless otherwise agreed.
4.2 Overdue accounts may incur interest at 10% per annum calculated daily.
4.3 The Customer authorises PM&C to charge any card details provided for outstanding amounts.
4.4 The Customer agrees to pay reasonable recovery costs incurred in collecting overdue amounts.
5. Cancellations
5.1 Cancellations within 24 hours may incur:
- $50; or
- 20% of booking value (whichever is greater).
5.2 If access is not provided at the scheduled time, a call-out fee may apply.
6. Access & Utilities
Customer must provide:
- Safe and unobstructed access
- Electricity
- Running water
- Safe working conditions
PM&C may refuse or cease service if conditions are unsafe.
7. Condition of Premises & Pre-Existing Damage
PM&C is not liable for damage resulting from:
- Pre-existing wear and tear
- Deteriorated or brittle materials
- Loose fixtures
- Poor paintwork
- Improper installations
- Items not secured
Customer must disclose fragile or high-value items before service.
8. Claims & Rectification
8.1 Claims must be reported within 24 hours of completion.
8.2 PM&C must be given reasonable opportunity to inspect and rectify.
8.3 Refunds will not be issued unless PM&C cannot reasonably rectify the issue.
9. Limitation of Liability
9.1 To the extent permitted by law, liability is limited to:
(a) Re-supply of services; or
(b) Cost of re-supply.
9.2 PM&C is not liable for indirect or consequential loss.
10. Keys & Security
Reasonable care will be taken with keys.
Customer remains responsible for property security.
11. Health & Safety
PM&C may refuse or cease services where:
- Hazardous substances exist
- Mould infestation is present
- Pest infestation is severe
- Biohazards are present
- Aggressive or unsafe behaviour occurs
Cancellation fees may apply.
12. Force Majeure
PM&C is not liable for delays due to events beyond reasonable control including weather, illness, breakdowns , or subcontractor/staff taking leave or not arriving at the venue or government restrictions.
13. Privacy
Personal information is collected for service delivery and payment processing only.
14. Governing Law
These Terms are governed by the laws of Western Australia.
PART B — COMMERCIAL TERMS & CONDITIONS
(For business clients, real estate agents, builders, offices)
1. Payment Terms
1.1 Payment due within agreed trading terms.
1.2 Overdue amounts incur interest at 12% per annum calculated daily.
1.3 All recovery costs including legal fees on a full indemnity basis are payable.
2. Suspension
PM&C may suspend services immediately for:
- Non-payment
- Breach of contract
- Unsafe site conditions
3. Charge Over Property (Commercial Only)
The Customer charges in favour of PM&C all present and after-acquired property to secure unpaid amounts.
4. Indemnity
The Commercial Customer indemnifies PM&C against claims arising from:
- Unsafe site conditions
- Incorrect instructions
- Third-party interference
- Access delays
5. Limitation of Liability
PM&C’s aggregate liability is capped at the total fees paid under the relevant Contract.
No liability for:
- Loss of profit
- Business interruption
- Consequential loss
6. Subcontracting
PM&C may subcontract services without notice.
7. Termination
PM&C may terminate services for material breach with immediate effect.
PART C — END OF LEASE ADDENDUM
(Attach to Residential Terms when performing bond cleans)
1. No Bond Guarantee
PM&C does not guarantee full bond return.
Bond decisions are made by landlords or agents.
Cleaning does not include:
- Structural repairs
- Painting
- Carpentry
- Pest control
- Mould remediation
- Silicone replacement
3. Pre-Existing Issues
PM&C is not responsible for:
- Permanent staining
- Water damage
- Rust
- Age-related deterioration
- Construction defects
4. Agent Standards
Real estate agents may impose subjective standards.
PM&C will clean to reasonable professional standard only.
5. Rectification
Rectification must be requested within 24 hours with picture and video proof.
PM&C must be given access before third-party cleaners are engaged.
